Case against City of Independence, Independence Power & Light ends, no evidence IPL overcharged customers or violated charter

The Missouri Court of Appeals has issued a decision in the 2018 class action lawsuit against the City of Independence and Independence Power & Light (IPL). The court found there was no evidence to suggest the City of Independence or IPL overcharged customers or violated the City Charter.

City of Independence prevails in Jackson County’s Motion to Dismiss lawsuit over property tax assessments

The Independence City Council filed suit against Jackson County in September 2023 due to the known issues with Jackson County’s 2023 assessment process. Jackson County filed a Motion to Dismiss the lawsuit, which was heard on December 20, 2023, by Cass County Associate Circuit Judge Derek Spencer, who was assigned the case after all Jackson County judges recused themselves. Judge Spencer agreed with the City, who is represented by Charles Hatfield of Stinson, LLP, and denied Jackson County’s Motion to Dismiss, confirming that the City may proceed to the merits of its claims.
